Procurement Act 2023 - Find a Tender

On the 24th of February 2025, following a delay, the new Procurement Act 2023 began. This still requires some organisations who receive public funding to publish their contract opportunities for Gas and Electricity supplies, which are above a defined threshold.

Its purpose is to allow transparent and fair competition that can benefit both the contracting parties and suppliers. However, this does mean an additional process for buyers and potential delays.

A noticeable change has been the end of Contracts Finder. These lower “below threshold” Notices are now also published on Find a Tender, but with fewer obligations.

Buyers have been given more control to design their own process as long as it is clearly defined to all parties from the start.

The award based on the “most economically advantageous” offer has been replaced with the “most advantageous” which encourages other factors to be considered within the decision making, rather than a focus on price. For contracts over £5 million there are additional requirements involving the setting and reporting of key performance indicators.

Thresholds to publish (including VAT)

  • Central Government – £139,688
  • Other Authorities – £214,904
  • Below Threshold – Central Government – £12,000
  • Below Threshold – Other Authorities – £30,000
